Former TJJD employee indicted for indecency with a child after alleged incident at Giddings State School

Isaiah Xavier Smith is already in the Travis County Jail on an indecency with child charge stemming from an alleged incident at Akins High School in Austin.

GIDDINGS, Texas — A Lee County grand jury has indicted a former correctional officer with the Texas Juvenile Justice Department (TJJD) for allegedly inappropriately touching an underage male at the Giddings State School in 2022.

According to a press release from the Office of the Inspector General (OIG) at the TJJD, 28-year-old Isaiah Xavier Smith has been indicted on one count of Improper Sexual Activity with Person in Custody, a first-degree felony, and one count of Indecency With a Child, a second-degree felony.

The OIG said the indictments are the result of an investigation into an incident that occurred in September 2022. While working as a juvenile correctional officer at the Giddings State School, Smith allegedly sexually touched a male juvenile.

This case was presented to a Lee County grand jury by the Special Prosecution Unit, which the OIG said will handle the prosecution.

The OIG said the Improper Sexual Activity charge is punishable of up to a $10,000 fine and 10 to 99 years in prison. The Indecency with a Child charge is punishable by up to a $10,000 fine and two to 20 years in prison. 

Smith is currently in the Travis County Jail on charges unrelated to these new indictments. Back in December, KVUE reported that Smith had been arrested for indecency with a child after an alleged incident at Akins High School, where he worked as a college readiness tutor.
