Pregnant Texans can’t get divorced until after giving birth. Here’s why

Texas is one of four states to prohibit pregnant people from finalizing a divorce.

TEXAS, USA — In recent weeks, conversations around pregnancy and divorce have become increasingly popular online after a social media post sparked discussion about Missouri laws. 

According to the state's law, Missourians cannot finalize a divorce while pregnant but they aren't the only ones. 

In fact, Texas is one of four states across the U.S. that prohibits finalizing a divorce until a pregnant person gives birth.

The American Pregnancy Association states Texas, Missouri, Arizona and Arkansas all require married couples to wait until their baby is born to complete divorce papers.

The reason for this decision is because the state is unable to make decisions on a child until after they are born. Once the baby is born, courts can further discuss concerns of child support and parental custody.

Pregnant Texans can file for divorce, though, and they can also begin mediation to further speed the process along. It's important to note after filing a petition, Texans must comply with a two-month-long waiting period.
