Former Texas State student sentenced to 14 years for drunk driving crash

A jury sentenced a Texas State student to 14 years in prison for killing a man and his unborn child in August 2016.

SAN MARCOS, Texas -- A former Texas State student, who pleaded guilty to causing the deaths of a man and his unborn child after she drove intoxicated, was sentenced to 14 years in prison with a concurrent 10-year probation Thursday, April 12, 2018.

The final sentencing for Shanna Elliott, 22, came a month after she told a jury that she made the worst mistake when she drove drunk on Aug. 2, 2016, killing Fabian Guerrero-Moreno, 23, and his pregnant wife's unborn child.

“You’re a monster, you’re not sorry for what you’ve done, you’re sorry because you got caught," Kristian Guerrero said after the sentencing.

Elliott was sentenced to seven years in prison for each of the two intoxication manslaughter charges and 10 years probation for the intoxication assault charge in the case.

Elliott will have to serve half of her sentence before she would be eligible for parole.

Kristian Guerrero did not mince words when she spoke to Shana Elliott in court Friday.

"You have shown you're incapable of remorse, I don't buy your crocodile tears, or the sweet little innocent girl they try to portray you to be, you're a monster, you're not sorry for what you've done, you're sorry because it landed you right there, you're sorry because you got caught," said Guerrero.

Guerrero told Elliott to not cry as she spoke to her.

"You murdered my family," said Guerrero.

Guerrero called Elliott a murderer and thief, saying she stole her life.

"How do you live with yourself," said Guerrero.

Throughout the week of testimony, Elliott's lawyers urged the jury to give her probation. They said Elliott had a rough childhood and coped by using drugs and alcohol.

She was out on bond at the time of the crash.

"As soon as the accident happened, I knew I made the worst decision ever," Elliott told the jury Thursday in her testimony.

But Guerrero said she and her husband also didn't have an easy upbringing either.

"Did you see us out there doing anything illegal," Guerrero said to Elliott. "Did you see us out there selling drugs? Did you see us out there murdering people? No. And that's the difference between you and me."

While the jury gave Elliott her punishment, it's Guerrero who has the life sentence of grief.
