Driver indicted in crash that killed man, unborn baby

The 24-year-old Texas State student who allegedly struck a vehicle while driving drunk resulting in the deaths of a man and his unborn baby was indicted in Hays County last week.

The 24-year-old Texas State student who allegedly struck a vehicle while driving drunk resulting in the deaths of a man and his unborn baby was indicted in Hays County last week.

County records show that Shana Lee Elliot was indicted for two counts of intoxication manslaughter, a second-degree felony, and intoxication assault with a vehicle, a third-degree felony. Her arraignment is scheduled for Monday.

According to an arrest affidavit, Shana Lee Elliott, 24, was driving inbound on Highway 21 just after 6:00 p.m. on August 2 when she allegedly crossed the center line and struck a Corolla that was traveling in the opposite direction.

Inside the Corolla was Kristian Nicole Guerrero, 24, and Fabian Guerrero-Moreno, 23, who were a married couple, according to the City of San Marcos. Geurrero-Moreno died shortly after the crash and Guerrero, who was five-months pregnant, was taken to St. David's South Austin Medical Center for treatment. Her unborn child did not survive.

According to police, Elliot told authorities she had just finished floating the river at Texas State Tubes, where she indulged in beer and liquor, before getting into her vehicle.

Witnesses at the scene also stated they saw Elliot outside of her car wearing a bikini while allegedly rolling a bottle of alcohol under a vehicle.
