Day care owner indicted in connection to infant's death

A grand jury has indicted a Georgetown day care owner on two charges in relation to the death of a 5-month-old boy in her care in January.

A grand jury has indicted a Georgetown day care owner on two charges in relation to the death of a 5-month-old boy in her care in January.

The grand jury returned indictments on charges of injury to a child and tampering with evidence against Holly Harrison. Harrison allegedly waited 14 minutes to call 911 in January after she found 5-month-old Brody Havins unresponsive.

According to the indictment documents, a grand jury determined: Harrison had too many children in her care, waited too long to call 911, and didn't remove the glove in Havins throat in a reasonable amount of time.

They also say she didn't perform CPR in a reasonable time or manner.

Harrison will need a new attorney for the trial, as previous attorney Laura Barker won an election for Williamson County Court at Law No. 2 judge this spring.

Monday, the Department of Family and Protective Services sent Harrison a letter at the conclusion of their investigation.

Harrison has 15 days to request an administrative review.

In the investigation, DFPS investigators found a number of infractions. In one section the report says Harrison was "texting on a cell phone while performing chest compressions" in regards to Havins.

The report also says Harrison waited at least 15 minutes between the time the child was found unresponsive and contacting emergency services.

Another infraction says "During an investigation, it was found that the home did not have individual cribs for each infant in care."

The report says parents weren't allowed to come into the home during hours of operation without permission from the caregiver. That goes against DFPS rules.

The Tarrant County medical examiner's office in Fort Worth conducted the autopsy for Brody Havins, and say they finished their report.

Now Judge Bill Gravell will meet with investigators and read that report to determine a cause of death soon.
