Man accused of sexually assaulting 16-year-old girl in Austin, police say

According to police, the suspect was 21-years-old when he sexually assaulted the victim in Austin.

AUSTIN — A 23-year-old man has been accused of sexually assaulting a 16-year-old girl in Austin back in April 2016.

According to an arrest affidavit, in April 2016, the victim was invited to go to dinner with her friend, but when her friend arrived to pick her up, she was with her older boyfriend.

The victim reportedly told police she got in the car thinking they were going to a restaurant, but her friend's boyfriend took them to Club El Nocturno located at 7601 North Lamar Blvd.

Police said the friend's boyfriend was able to get them into the club and purchased alcoholic drinks for them even though they were underage.

The victim reportedly told police while she was in the club, she met the suspect, identified as Daniel Chavez, now 23-years-old.

Police said when the group decided to leave the club, the victim and her friend started feeling "light-headed" as they walked to their vehicle.

The victim said when they arrived at the vehicle, her friend's boyfriend insisted that she needed to ride with Chavez and follow them to a restaurant nearby, according to the affidavit.

According to police, Chavez drove the victim to the restaurant but parked far away. Chavez then allegedly started sexually assaulting the victim.

The victim reportedly told police Chavez then drove her to a nearby church where she met up with her friend and her friend's boyfriend.

Police said Chavez was 21-years-old when he sexually assaulted the 16-year-old victim.

Chavez has been charged with sexual assault of a child. According to online records, he is not in police custody as of Wednesday afternoon.
