164 DWI arrests during Memorial Day/ROT Rally No Refusal, police say

Police said around one-third of the 164 DWI arrests were for misdemeanor DWI.

AUSTIN – More than 160 people were arrested for DWI during the No Refusal period that encompassed Memorial Day and ROT Rally weekends.

APD said the 164 arrests included 9 felony DWI arrests (two or more prior convictions), one felony DWI with child passenger arrest, one boating while intoxicated arrest, and more than 50 misdemeanor DWI arrests (with prior conviction or breath sample over .15). The No Refusal period operated 9 p.m. to 5 a.m. each night between May 26 and June 12.

Police also noted that the highest breath test recorded during the No Refusal period was a .276, which is more than triple the legal limit.

During the 2016 ROT Rally, APD reported 33 DWI arrests, but the numbers only included information from two nights (June 10-11 and 11-12).
