Attorneys for yogurt shop defendants ask judge to lift gag order
06:47 PM CDT on Wednesday, August 20, 2008
Attorneys for defendants in the 1991 yogurt shop murders Wednesday asked the judge to lift a gag order in the case.
Attorneys for Michael Scott and Robert Springsteen say the gag order is preventing them from responding to statements from prosecutors about the source of DNA evidence in the case.
"I think there is a concerted effort by the state to leave this case shrouded in secrecy, particularly since they came out and said publicly we know whose DNA this is, we're going to prove this. It's only a question of time, the defense is wrong," said Joe James Sawyer, attorney for Robert Springsteen. "Well the defense is right. The defense told the truth."
Springsteen and Scott are accused of the 1991 murders of four teenagers at a North Austin "I Can't Believe It's Yogurt Shop." Amy Ayers, Jennifer Harbison and her sister, Sarah, and Eliza Thomas were killed.
Judge Mike Lynch refused to alter his existing gag order, and noted that no one objected when he imposed it several months ago.
