Colvin found guilty of aggravated assault, but not manslaughter
10:25 PM CDT on Wednesday, October 22, 2008
A Travis County jury stayed late Wednesday to deliver a verdict in the trial of Kurtiss Colvin.
Colvin was found not guilty of manslaughter, but the jury did find him guilty of a secondary charge of aggravated assault with serious bodily injury. The jury also found that he used or exhibited a deadly weapon in the commission of the offense; in this case, the deadly weapon was his fist since he was a former Golden Gloves boxer.
Colvin told jurors Wednesday he did not deliver a punch, but instead, more of a shove, in a June 2007 altercation that ended in a man's death.
David Morales was knocked to the ground in an East Austin parking lot while trying to diffuse a tense situation after a co-worker bumped into a child with his car.
Police say Kurtiss Colvin killed Morales when he knocked him to the ground. Colvin showed jurors in a re-enactment of the events it was more of a shove, rather than a punch, putting both men on the ground.
During testimony Tuesday afternoon, a teenager already convicted in Morales' death told the jury that he hit Morales after Colvin. Witnesses have also testified that Morales' skull cracked after the second punch.
Jurors heard closing arguments and began deliberations Wednesday afternoon.
