Man reaches plea deal in death of cyclist
10:29 PM CDT on Friday, July 11, 2008
Sixty days in prison and eight years probation is the agreement attorneys and a victim's family have settled on in the death of Vilhelm Hesness.
The 56-year old attorney and professor was killed while riding his bicycle on Manchaca in July of 2007.
Detectives said Hesness wasn't breaking any laws. But he would soon come across someone who was that day.
Richard Alan Lee, 42, is charged with striking Hesness from behind with his SUV with such force it knocked the cyclist clear out of his shoes.
Lee was later charged with intoxication manslaughter. Toxicology test results showed that Lee was under the influence of five different pain medications at the time of the accident.
"I think a more accurate a more appropriate punishment would be for him to lose his driver's license forever," said Fred Meredith, the editor of Southwest Cycling and a friend of Hesness who interviewed him a month before he was killed. “"I think that sends a very bad message to the general public about such crimes."
The plea agreement is not a done deal however. A sentencing hearing is scheduled for the morning of July 25th in the 390th District Court.
