Texas Supreme Court to review seminary case

11:12 PM CST on Friday, December 3, 2004

Associated Press

The Texas Supreme Court today agreed to consider whether degree-awarding seminaries can be regulated by the state.

The case stems from a $173,000 fine against Tyndale Theological Seminary in Fort Worth for issuing degrees without state authority to do so.

The fine was imposed in 1998 by the Texas Higher Education Coordinating Board.

Records show the seminary, operated by HEB Ministries, issued 34 diplomas without proper state authority.

Texas bars unaccredited private post-secondary institutions from awarding degrees without state certification.

The state also prohibits an institution from using "seminary" in its name if it can't lawfully award degrees.

Tyndale Seminary, the Southern Bible Institute of Dallas and the Hispanic Bible Institute of San Antonio sued the state.
