Jury deadlocks in fraternity lawsuit

A district court judge declared a mistrial Monday in a lawsuit against a fraternity at the University of Texas.

Wes Holloway sued Alpha Tau Omega for $25 million after diving into a pool with less than a foot of water at the fraternity house in May 2003. Holloway says he broke his neck because of the accident, and wanted the fraternity to pay for damages.

The jury deadlocked on which party is more to blame for the accident that left Holloway paralyzed from the waist down.

A new trial date has not been set.
