Spicewood bar closes after TABC investigation
06:58 PM CDT on Wednesday, August 1, 2007
The Texas Alcoholic Beverage Commission and the owners of Cedar's Bar & Grill in Spicewood Wednesday agreed to officially shut down the establishment.
The bar is where an Austin police commander and her husband, a former officer, both died in a motorcycle crash after drinking.
"As of today the alcoholic beverage commission has finally cancelled the permits for the alcoholic sales for the Cedar's Bar & Grill," said Lt. Robert Saenz, TABC.
The TABC began taking a close look at Cedar's Bar & Grill in December 2004, when Shauna Jacobson, an Austin police commander, and her husband, Kurt Jacobson, a former officer, both died after crashing into a barrier on Highway 71.
The couple was one of dozens of off-duty officers drinking inside the bar before the crash.
"If they're all fellow officers, they didn't recognize the fact that he was intoxicated enough to go out and kill himself and I'm supposed to?" said Bob Bailey, owner of Cedar's Bar & Grill in a 2004 interview.
At one point Jacobson drove his motorcycle inside of the bar and left a mark when he burned out.
His blood alcohol content was more than three times the legal limit. Shauna Jacobson's blood alcohol content was more than four times the limit.
Bailey told KVUE news over the phone that he never agreed to close his bar. He says the TABC demanded it and he says he simply said "okay."
Most of the people who spoke with KVUE News say the decision to close Cedar's reeks of a double-standard.
"I've learned that they seem to want to conduct themselves by a different set of rules than they expect us to conduct ourselves by," said Jesse Williamson, Dripping Springs resident.
"I think it's kind of ridiculous that they're shutting it down 'cause it's not the bar's responsibility as to who's drunk because sometimes people can drink a whole case and you don't even know they're drunk," said Gary Green, Spicewood resident.
