AUSTIN -- A man police say is responsible for the death of Austin police officer Jaime Padron appeared at his first pre-trial hearing Tuesday in Travis County.

Prosecutors requested their own expert perform a psychiatric evaluation of Brandon Montgomery Daniel, 25.

Judge Brenda Kennedy with the 403rd Criminal District Court is expected to make a ruling in the matter on October 1.

In December of 2012 Daniel gained a new defense attorney, Russ Hunt. The move came after attorney Bill White withdrew from Daniels’ case following what defense called “recent issues.”

In November, Travis County District Attorney Rosemary Lehmberg announced she would seek the death penalty in the case.

Daniel faces charges of capital murder in the April, 2012 death of officer Padron.
