CALDWELL COUNTY, Texas -- A man was charged with attempted capital murder and deadly conduct Thursday after shooting at an officer.

78-year-old Gilbert Montoya was arrested Wednesday, approximately three hours after the incident began. 

Caldwell County Sheriff's Office said a deputy was dispatched to 3722 Old Kelly Road on a complaint of discharge of firearms. While checking the area, several shots were fired at the deputy, but the officer managed to escape unharmed.

Hays County SWAT detained and released Montoya to Caldwell County deputies. Montoya was transported to the Caldwell County Jail.

Montoya's bond was set at $1 million for the attempted capital murder offense, and $200,000 for the deadly conduct offense.

According to the Caldwell County Sheriff's Office press release, deputies have responded to Montoya’s residence on prior complaints of discharge of firearms.
