Judges panel to consider new Pitonyak trial

AUSTIN -- The man convicted of killing Jennifer Cave could soon be back in the courtroom.

A panel of judges is set to meet Tuesday to determine whether Colton Pitonyak should get a new trial.

In 2007, a jury convicted him of killing Cave and sentenced him to 55 years in prison.

Pitonyak and an accomplice, Laura Hall, decapitated and dismembered Cave's body in Pitonyak's West Campus condo.

His attorneys say that during Pitonyak's trial, prosecutors knew about statements Hall made in jail claiming she had killed Cave. They say the defense was not notified as required by law and the 5th Circuit Court of Appeals agreed to review the case.

Hall is is serving a 10-year sentence for evidence tampering and hindering apprehension.
