Sitter convicted of killing baby won't face death in retrial

AUSTIN, Texas (AP) -- Central Texas prosecutors will not seek the death penalty against a woman who won a retrial after previously being convicted of killing a 3-month-old child.

Cathy Lynn Henderson was just days away from execution in 2007 when a state appeals court halted her punishment. The same court in December awarded the 56-year-old Henderson a new trial.

The Austin American-Statesman reports that advances in pediatric injuries call into question how infant Brandon Baugh suffered a fatal head injury in 1994.

Travis County District Attorney Rosemary Lehmberg says Henderson will be tried for capital murder and faces a life sentence.

Henderson claims the infant slipped from her arms and fell to the floor of her home north of Austin. She said she panicked and buried the body in a field before fleeing Texas.
