AUSTIN -- The family of a man hit and killed by a Capital Metro train is suing the transit agency.
A commuter rail train slammed into 32-year-old Jeremy Barta's car last spring near MoPac and Scofield Ridge. Barta's two young sons were both seriously injured.
The family is seeking more than a million dollars for funeral and medical expenses as well as mental anguish. They claim the agency failed to maintain the crossing and didn't warn drivers they could get stuck.
Capital Metro officials say they haven't yet been served with that suit.
