AUSTIN -- The man accused of killing an Austin police officer was scheduled to be in court Tuesday, but his appearance has been delayed.
Brandon Daniel had a pre-trial hearing set for 1:30 p.m. He was charged with capital murder after APD Senior Officer Jaime Padron was shot to death in April of 2012.
Officer Padron was responding to a report that Daniel was shoplifting at a Walmart store in North Austin. The two men got into a struggle when Daniel allegedly shot Padron.
If convicted Daniel faces the death penalty.
