Teen charged in alleged assault on jail guard

AUSTIN - A teen inmate at the Travis County Jail has been charged after he allegedly assaulted a jail guard on Sept. 14.

The arrest affidavit for Cristhian Diaz-Rivera, 17, states a guard was collecting dinner trays around 4:20 p.m. Sept. 14 when Diaz-Rivera allegedly hit the guard in the back of the head with a tray. The guard said Diaz-Rivera broke his nose with the tray before he began punching the guard in the face. One of the punches caused a cut to the guard’s eyebrow, which the affidavit said caused profuse bleeding.

The affidavit states the guard called for assistance and that he and Diaz-Rivera began fighting again. Diaz-Rivera allegedly broke free from the guard and attempted to flee toward another unit in the jail. According to the affidavit, officers intercepted Diaz-Rivera and took him back into custody before he could leave the unit.

The guard was taken to Seton Medical Center Austin to be treated for his injuries and discharged the same day, the affidavit said. The guard told police he had very little interaction with Diaz-Rivera before the alleged assault.

Online records at the jail state Diaz-Rivera was booked the morning of Sept. 10 on charges of burglary of a vehicle and failing to identify. He has been charged with felony escape from custody. Diaz-Rivera is being held on a combined $58,000 bond. A booking photo is not available due to his age.
