In a rare move Wednesday, the U.S. Consumer Product Safety Commission sued the maker of a product linked to five infant deaths.

Baby matters makes the Nap Nanny and Chill model infant recliners which the CPSC said have a design defect that can let children fall out.

The feds said the company refused to issue a voluntary recall and instead simply changed the warning language.

This is only the second time the CPSC has taken this kind of action in more than a decade.
