AUSTIN, Texas (AP) -- A Texas grand jury has declined to indict a sheriff's deputy who fatally shot a man in 2011.

Our partners at the Austin American-Statesman reported Friday (http://bit.ly/1545hta ) that Travis County Sheriff's Deputy Carlos Rodriguez was a member of the SWAT team sent to apprehend 31-year-old Joshua Samuelson near Elroy.

Relatives of Samuelson had summoned officers to Elroy, about 15 miles southeast of Austin. Family members said Samuelson was threatening to hurt himself and had texted pictures of him with a shotgun.

Sheriff's spokesman Roger Wade said at the time that Samuelson came out of a home, confronted two deputies and refused to put down his weapon.

Wade said Rodriguez shot Samuelson after he raised a gun toward a deputy.

Wade declined comment Friday citing a pending lawsuit.
