KYLE, Texas -- Kyle Police Department is investigating the death of a man found lying near the roadway at intersection FM 1626 and Kohlers Crossing.
The man was identified as 37-year-old Phillip Duran, a Kyle resident.
Duran was last seen by his mother when he left their home Saturday around 10 p.m. to go for a jog. His brother, Chad Benninghoff, says Duran asked him to go jogging with him. His brother couldn't because of a hurt foot.
When Benninghoff found out that his brother didn't return home, he told their mother to call police. She did, and Benninghoff joined the search for him. He eventually found his brother in the tall grass on the side of the road.
"Not a sight any sibling or mother or father should have to see," Benninghoff said.
Police suspect that Duran was killed in an auto-pedestrian accident, but will confirm the cause of death once the investigation has been completed.
Police said parts of a vehicle were found on the street, including the side mirror. The vehicle parts in question are believed to be consistent with those found of a 2000-2006 Tahoe, Suburban, or Yukon, and are black in color.
Through information Benninghoff posted on Facebook, a woman contacted him saying she'd seen the truck and stopped and asked if they needed help. She said they told her they hit a deer, so she left.
"They deliberately lied to her and then drove off and left my brother there to die," said Benninghoff.
