Several families are suing the State of Texas over their children's DNA samples.
State law requires that five drops of blood must be collected from every newborn before they leave the hospital.
The samples are then screened by the state for a list of serious medical conditions.
But in 2002 the Texas began saving the leftover specimens without parental consent.
They used the blood samples for research.
Some parents say it is a violation of their children's privacy.
The State admits some of the blood samples collected for the newborn screening program were used for other purposes, but they said it was done in accordance with federal and state law.
