AUSTIN -- The man accused of killing an Austin police officer is scheduled to be in court Thursday.

Brandon Daniel has a pre-trial hearing Thursday afternoon. He's charged with capital murder in the shooting death of APD Senior Officer Jaime Padron in April 2012.

Padron was responding to a report Daniel was shoplifting at a North Austin Walmart. The two got into a struggle, and Daniel allegedly shot Padron.

If convicted Daniel faces the death penalty.
