DA Lehmberg sentenced to 45 days in jail

AUSTIN -- Travis County District Attorney Rosemary Lehmberg has been sentenced to jail for 45 days, and her license will be suspended for 180 days, after pleading guilty  to driving while intoxicated and an open container violation.

The sentence is the harshest given by Travis County for a first time DWI offense.

On Friday Lehmberg made her first court appearance. KVUE was told that the DA hopes serving jail time will help the public forgive her mistake, since she hopes to stay in office. She says she is "extremely sorry" and takes the sentence seriously.

Lehmberg was handcuffed in the courtroom after entering her guilty plea. She will begin her jail time immediately.

Last Friday Lehmberg was arrested for driving drunk off RM 620. Her arrest affidavit says she had an open container of vodka sitting on her front passenger seat. Travis County deputies say she appeared disoriented, her speech was slurred and her body was wobbling and staggering.

Authorities say she was extremely combative when under arrest, kicking and spitting on officers. At one point she had to be put into a restrained chair.
