AUSTIN -- The Travis County Attorney dismissed one lawsuit Monday to remove District Attorney Rosemary Lehmberg from office and then filed another.
Lehmberg pleaded guilty to DWI after an arrest earlier this month. She is serving a 45 day jail sentence and says she does not plan to resign.
The attorney who filed the original petition against Lehmberg says this new lawsuit is similar. However, the attorney asks whether her drunk driving was a single incident or an ongoing problem.
