Round Rock Police arrested a high school senior who is facing charges of aggravated assault on a public servant with a deadly weapon.

According to an arrest affidavit, Stony Point student Nathan Allred hit parking lot attendant Richard Tohlen with a car. Allred was driving another students’ vehicle at the time.

The affidavit says Tohlen told police the teenager drove straight at him and struck him on the inside of his right knee. The affidavit also says a doctor revealed that his knee cap was most likely fractured.

Some Stony Point students are allowed to leave the Round Rock high school, but a parking lot security attendant checks ID cards to make sure only seniors are leaving school grounds.

Attendant Richard Tohlen is now back at work after being injured Sept. 2.

“Anytime a student goes after one of our employees we take that very seriously,” said Round Rock ISD spokesperson JoyLynn Occhiuzzi.

Allred is now facing a felony charge of aggravated assault on a public servant using a deadly weapon. The affidavit said the weapon is a 2008 Chevy Cobalt that Allred had borrowed from another student. A witness told police Allred "floored it" towards Tohlen.

According to the affidavit, Allred said he was driving during the incident, but he thought Tohlen jumped out of the way and did not get hit.

Beyond criminal charges, Round Rock School District spokesperson JoyLynn Occhiuzzi says Allred will also face discipline at school. She says punishment ranges from in-school suspension to expulsion.

“It depends on the extent of what the student did, and anytime there is a student attacking any of our employees the consequences will be more severe,” said Occhiuzzi.

Aggravated assault on a public servant with a deadly weapon is a first degree felony. It carries a punishment of five to 99 years in prison.
