Austin City Council rejects Sanders settlement

It was a packed house at City Hall on Thursday as council members considered paying out a $750,000 settlement to the family of a teen killed by an APD officer.
 
At 7:30pm Thursday, council rejected the settlement 4-3. This means the case will now go to trial.
 
Here's how the vote broke down. Mayor Lee Leffingwell, Mayor pro-tem Mike Martinez and council members Chris Riley and Randi Shade voted to reject the settlement.
 
Council members Laura Morrison, Bill Spelman and Sheryl Cole voted in favor of the settlement.
 
Nathaniel Sanders, 18, was fatally shot by Austin police officer Leonardo Quintana in May 2009, as the officer was checking out reports of gunfire at an East Austin apartment complex.
 
Earlier this month city officials granted Sanders' family a $750,000 settlement, but it was ultimately up to council members to accept or reject the agreement.
 
Sanders' family filed a Civil Rights lawsuit against the city and Quintana. Last month the city was dropped from the suit, leaving Quintana as the only defendant. The city is still responsible for any damages against Quintana because he was on the job.
 
A grand jury cleared Quintana of criminal wrongdoing, but a private investigation later uncovered what it described as misconduct and flaws in the subsequent investigation.
