State appeals court rules against making 'revenge porn' a crime

AUSTIN — A state appeals court stuck down a law Friday that made it a crime to post "revenge porn."

Revenge porn is a term used when intimate photos or videos from a previous or current relationship are posted on the internet without consent.

The law, which was first introduced in 2015 with unanimous support from the House and Senate, made Texas one of the only states that offered victims both a criminal and civil cause of action. According to the Texas Tribune, the appeals court ruled that the statute is overly broad and violates the First Amendment.

Texas Democratic Party Press Secretary Delma Limones said in a written statement she is upset with this ruling.

“We are disappointed and sickened by the ruling handed down by the panel of three Republican judges in the 12th Court of Appeals. We call on Attorney General Ken Paxton to do the right thing for victims of revenge porn and intimate partner violence and immediately appeal this decision,” Limones said.
