Harris County prosecutors will dismiss a murder charge against the man who police identified as a prime suspect in the shooting of State District Judge Julie Kocurek, the man's attorney told KVUE's and the Austin American-Statesman's Tony Plohetski Friday.
The dismissal of the charge against Chimene Onyeri will allow him to be brought to Austin to face a motion to revoke his probation on a 2012 larceny charge in Travis County, attorney Sam Adamo said.
Onyeri has not yet been charged in Kocurek's shooting, which remains under investigation.
Houston police had accused Onyeri of killing Jacobi Demond Alexander, 31. Investigators believe two men shot Alexander outside the Falls of Bellaire apartment complex in Houston.
When Onyeri was described by police as the "prime and only suspect" in Kocurek's shooting, Onyeri's attorney said he had been framed by an ex-girlfriend and that he had no motivation to harm a judge. He said he realized that doing so would not have prevented him from going to prison.
