18-year-old charged after shooting at Austin officer Thursday morning

The 18-year-old has been charged with aggravated assault and resisting arrest.

AUSTIN — An 18-year-old has been charged with aggravated assault and resisting arrest after he allegedly shot at an Austin officer Thursday morning.

According to police, at roughly 12:54 a.m., two officers were patrolling the 6900 block of Trandal Lane in southeast Austin when they saw a blacked out vehicle with two men inside parked on the side of the road.

Police said the two men ducked down in the vehicle when the officers passed by, which raised concern.

When police approached the vehicle, they reportedly smelled the odor of marijuana and removed the driver from the car. As police were removing the passenger, identified as Damon Benavidez, he allegedly used a gun to shoot at an officer. The gun went off right next to the officer's face and the officer suffered minor injuries, police said.

The driver ran away during this incident, but was later caught by police and has been charged with retaliation, harassment of a public servant, evading arrest, possession of a criminal instrument and failing to ID. Benavidez was also taken into custody, Austin police said.
